How Do I Know If I Am Affected by the Settlement?
You are
included in the Class if you:
- Rented a vehicle in the United States from Dollar Rent A Car or Thrifty Car Rental between December 19, 2009 and December 31, 2015,
- Selected the prepaid fuel option,
- Paid a prepaid fuel charge that was based upon a fuel capacity listed in the rental vehicle profile that exceeded the actual fuel capacity of the vehicle, and
- Are included in the Settlement Class List.
The
Settlement Class does not include:
- DTAG and its parent companies, subsidiaries, or affiliates;
- The officers, directors, agents, servants, or employees of DTAG (or their parent companies, subsidiaries, or affiliates) as of November 27, 2018 [the entry of the Preliminary Approval Order];
- The Settlement Administrator; and
- Any judge presiding over the class action.
What Is the Lawsuit About?
The lawsuit claims that Dollar Rent A Car and Thrifty Car Rental charged the members of the
Settlement Class for prepaid fuel based on fuel volumes that exceeded the fuel
capacities of the rental vehicles. DTAG
denies these claims and maintains it did nothing wrong.
What Can I Get in the Settlement?
If
the Settlement is approved and any and all appeals are resolved in its favor
(if it “becomes final”), it will provide benefits to Class Members. DTAG will
provide Settlement Funding up to $175,000 to make payments to Class Members who
file valid claims , as well as to pay for costs
associated with the administration of the Settlement, attorneys’ fees and costs
of not more than $50,625, and an incentive award of $10,000 to the Class
Representative .

How Do I Make a Claim?
Please read the
instructions carefully, and fill out the Claim Form completely and
accurately. Claim Forms can be submitted

or by mail. Your Claim Form must be submitted electronically at

Fairness Hearing
A Fairness Hearing will be
held before a Judge of the Court at 2:30 p.m. on January 28, 2019, in Courtroom
501, Circuit Court of the Thirteenth Judicial Circuit, in and for Hillsborough
County, Florida, 800 E. Twiggs St., Tampa, Florida 33602. The hearing may be
moved to a different date or time without additional notice, so it is a good
idea to check this website or call 1-877-261-8296.
At this hearing, the Court
will consider whether the Settlement is fair, reasonable, and adequate. If
there are objections, the Court will consider them and will listen to people
who have asked to speak at the hearing. The Court may also decide at this
hearing how much to pay Class Counsel. After the hearing, the Court will decide
whether to approve the Settlement. We do not know how long these decisions will
take.
